Article 1 (Application and Acceptance)
These Terms of Use (the "Terms") set out the conditions for using Castdeck (the "App") provided by CASTDECK (the "Provider").
Before installing, launching, or using the App, the user must review these Terms and may use the App only if they accept them. If you do not accept the Terms, do not use the App.
If the user uses the App for a corporation, organization, or third party, the user represents that they have authority to bind that corporation, organization, or third party to these Terms.
Article 2 (What the App Does)
The App is a desktop application that supports YouTube Live with comment retrieval, comment display, pinning, polls, viewer analytics, OBS overlay display, game effects, asset management, text-to-speech, and AI-based stream-support suggestions.
The App does not guarantee any stream results, viewer numbers, revenue, comment volume, effectiveness of AI suggestions, or continuous connectivity with external services.
Article 3 (Eligibility)
The user must be at least 13 years old. If a minor uses the App, they must do so with the consent of a parent or other legal guardian.
The user is responsible, at their own cost, for preparing the streaming platforms, OBS, AI services, OS, network, equipment, accounts, API keys, and other items needed to use the App.
Article 4 (Accounts, Credentials, and API Keys)
The App may integrate with the YouTube API, Google authentication, AI provider APIs, the BASE API, Amazon wish-list sync, and other external services.
The user must properly manage their own accounts, OAuth tokens, API keys, client IDs, client secrets, and other credentials, and must not disclose, lend, or share them with third parties.
The Provider is not liable for any damage arising from leakage or misuse of credentials, misconfiguration, insufficient permissions, usage limits, or changes to external service specifications.
Article 5 (External Service Conditions)
When the user uses YouTube, Google, OBS, AI providers, BASE, Amazon, OS-standard speech, or other third-party services through the App, the user must comply with each service's terms of service, developer policies, privacy policies, guidelines, rate limits, and rights-clearance rules.
The App uses YouTube API Services. By using the App (the API Client), the user agrees to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Users of YouTube features must also comply with the YouTube API Services Terms of Service, the YouTube API Services Developer Policies, and the Google Privacy Policy (https://policies.google.com/privacy).
Part or all of the App may become unavailable due to suspension, outages, specification changes, reviews, restrictions, account suspensions, API discontinuation, price changes, or model discontinuation of external services.

Article 6 (User Content and Rights)
Rights to the comments, images, audio, video, text, settings, notes, assets, stream information, and other data that the user registers, enters, displays, plays back, reads aloud, or uses for streaming in the App ("User Content") belong to the user or the rightful owner.
The user warrants that they hold the rights, licenses, and consents necessary to use, store, convert, display, play back, read aloud, show in OBS, analyze with AI, and reflect on the stream screen the User Content within the App.
The user must not use, in the App, any material or information that infringes the copyrights, trademarks, portrait rights, publicity rights, privacy, reputation, credit, trade secrets, or other rights of third parties.
Article 7 (Storage and Handling of Data)
The App may store settings, credentials, viewer notes, comment-related data, Super Chat history, AI suggestion history, asset references, a local database, and similar data on the user's own device.
The user is responsible for managing their device, OS account, backups, logs, asset folders, local database, and settings files.
The App may send comment statistics, stream status, entered content, and similar information to the AI providers or external services the user has configured, to the extent needed for AI suggestions or feature execution. When BASE integration is used, the App retrieves order information from the BASE API and uses it to show purchase/gift notifications. When Amazon wish-list sync is used, a bookmarklet the user runs in their browser sends information from the purchased list to Castdeck on the user's own device. Data sent to or retrieved from external services is handled in accordance with those services' terms and privacy policies.
Article 8 (AI Suggestions and Text-to-Speech)
Suggestions from the AI Advisor feature are reference information for stream support and do not guarantee accuracy, usefulness, legality, stream results, prevention of backlash, increased revenue, or viewer reactions.
The user decides, at their own judgment and responsibility, whether to adopt AI suggestions, what to say on stream, how to respond to comments, what effects to run, and how to guide viewers.
The text-to-speech feature uses OS-standard speech or an in-app fallback. The user is responsible for checking the settings and behavior before streaming, including the spoken content, pronunciation, volume, timing, mixing of audio into the external stream, and unintended reading of comments.
Article 9 (Prohibited Conduct)
In using the App, the user must not engage in any of the following.
- Conduct that violates laws, court orders, administrative guidance, streaming platform terms, or external service terms
- Conduct that infringes copyrights, trademarks, portrait rights, privacy, reputation, credit, or other third-party rights
- Use involving discrimination, threats, harassment, violent expression, sexual exploitation, content harmful to children, or promotion of illegal acts
- Spam, trolling, impersonation, unauthorized access, misuse of credentials, circumventing API limits, or sending excessive requests
- Conduct that interferes with the systems or networks of the App, external services, streaming platforms, viewers, or third parties
- Copying, modifying, reverse-engineering, redistributing, selling, leasing, or sublicensing the App, except where this cannot be prohibited under applicable law
- Circumventing or altering the App's display, notifications, terms acceptance, security, restrictions, or rights notices
- Other conduct that the Provider deems inappropriate
Article 10 (License)
Subject to compliance with these Terms, the Provider grants the user a non-exclusive, non-transferable, non-sublicensable, revocable right to use the App on the user's device.
Rights to the App and its name, logo, UI, programs, documentation, templates, presets, and other included materials belong to the Provider or the rightful owner.
Article 11 (Updates, Changes, and Termination)
The Provider may change the App or these Terms to add features, make improvements, fix bugs, address security, or respond to changes in external service specifications.
When there is a material change to the Terms, the App may request renewed consent. If the user does not accept the revised Terms, they cannot use the App.
The Provider may suspend or terminate the provision, updates, or support of part or all of the App, with or without prior notice.
Article 12 (Disclaimer of Warranties)
The App is provided "as is." The Provider makes no warranty, express or implied, regarding merchantability, fitness for a particular purpose, accuracy, completeness, continuity, safety, non-infringement, compatibility with external services, or stream results.
The user is responsible for verifying, before streaming, the App's settings, OBS display, audio, assets, external service integration, AI suggestions, stream-layout URL, game effects, goal display, and similar items.
Article 13 (Limitation of Liability)
Even if damage such as stream interruption, account suspension, lost revenue, data loss, asset corruption, external service failures, viewer handling, backlash, or claims from third parties arises in connection with the use or inability to use the App, the Provider is not liable except in cases of willful misconduct or gross negligence.
Even where liability cannot be fully excluded under applicable law, the Provider's liability is limited to direct and ordinary damages.
Article 14 (User Responsibility and Indemnification)
If the user breaches these Terms, breaches external service terms, fails to clear rights related to User Content, or a dispute arises with a third party due to the user's use of the App, the user must resolve it at their own responsibility and cost.
If the Provider incurs damage, costs, claims, or complaints due to the user's conduct, the user must indemnify the Provider.
Article 15 (Governing Law and Consultation)
These Terms are construed in accordance with the laws of Japan.
If any question or dispute arises regarding these Terms or the App, the user and the Provider will consult in good faith. For inquiries, please contact watanabeblue@gmail.com.
Article 16 (Paid Plans, Payment, and Refunds)
Some features of the App are offered as a paid plan, "Castdeck Pro" (a monthly subscription). Fees, included features, and conditions are as displayed in the App or on the official website (castdeck.studio).
Sales and payment processing for paid plans are handled by Paddle, acting as the Provider's Merchant of Record. In addition to these Terms, Paddle's buyer terms apply to purchases; Paddle handles payment processing, receipts, applicable taxes, and refunds. The Provider never stores your card or other payment details.
Subscriptions renew automatically at the end of each billing period unless cancelled, and the registered payment method is charged for the next period. You may cancel at any time and will retain access to paid features until the end of the current billing period. Cancellation is available via the link in your purchase confirmation email, or through support (the support page on the official website or the in-app Help). No pro-rated refunds are provided.
Refunds are handled case by case in accordance with Paddle's refund policy and applicable law. If you were charged twice, charged in error, or could not use paid features due to a material defect, please contact support (the support page on the official website or the in-app Help), or use Paddle's support desk linked in your purchase confirmation email. Given the nature of digital services, other refunds are generally not provided; however, nothing in this article limits rights granted by mandatory consumer protection laws.
The Provider may change fees or the contents of paid plans. Changes will be announced in the App or on the official website before they take effect, and revised fees apply from the next renewal. If you do not agree to a change, you may cancel before the next renewal.
